My wife has moved out of state to accept a new job, and I was supposed to follow when I could get a transfer, On a surprise visit I found her and another man in the house preparing to go out together, they have gone out before as well.
My question , she wants half of everything at our homestead ,should the money she has spent in relocating and setting up her knew life including rent for 6 months be considered towards her half of the settlement?? This money was joint funds and she spent it knowing she was escaping from the marriage when she left. I have found this out through e- mails to her where she stated that she saw the job as a way out of our marriage. ?????????????????? Scott |

We have not filed yet, most likely South Carolina, thats where all the property is, I was told due to our debts so far out exceeding our asset's that we should consider a mediater and come to an agreement before going to court.( suggested by lawyer on initial consultation) Thats why I was wondering if the money she has spent would be considered towards her portion of whatever is available to split up, since it was money that could have been spent on bills. I did not think to ask that question during my free consultation with the laywer!
