Question Crazy story of mine

O.k.. Ive been married for 4 years to T. i have a 2 year old (J) and a 1 year old (R). after J was born, my wife took J with her for a "getaway." durring her getaway, cheated on me with her ex. she told me they just kissed then, but recently i found she did more...and that my youngest daughter, R, may not be mine.

Me and their mother have been separated for a couple while now, not legally...no paperwork, she moved out. The girls have been going back and forth as if we had joint custody. About a month ago, their mother lost her job for stealing from the company. she got 2 years probation for it. this is when everyone starts to see how much shes changed. she went to work for a gas/grocer, and lost that one too. the reason being because i gave her $100, and $80 was to give to the babysitter, and she only gave her $40. so the sitter stopped watching my kids because of that. their mother told her i would pay her the rest, but she didnt tell me about it. she said the sitter stopped watching them because the sitter wanted her to loan her money, and that she didnt want to loan the sitter money, which happen to be the same amount that was unpaid to the sitter, no coincidence. so from that, their mother ended up losing that job, causing her to lose the apartment.

before losing her apartment, she didnt want to watch the girls because she didnt have adequate air conditioning, and she didnt want to get an emergency air conditioner. i mean you can get one for $100, but with her being the clubber she is, she couldnt afford it, and was ignorant to get emergency help. so from that, she wanted the girls to stay with me.

i lived with my parents, and still do. the reason is, is because when R was 10 months old, she had a liver transplant cause of a liver disease. i was her donor, so i couldnt work to help pay the bills. we were still together at this time, so we moved with my parents. she changed from the person i once knew, thats why i fell out of love with her. at this time noone can see hos shes changed. then she moved out because of the separation not too long after that.

so i agreed to keep the, why wouldnt i. she moved out, and moved in with her partner in crime, M, who lives in another state. its been more than 2 weeks since ive had the girls with me. she has only seen them 3 times since moving to another state. she would call to tell me that she would come to see them or pick them up, but never called back. she lied about when she started work, saying she was going to pick them up after she got off work at 3, but didnt, cause she didnt even start her job yet, and this was on a friday. ive had to bring them to her in order for her to see them; to the park, the pool, her new job. not once has she come stop bye to see them without me bringing them to her somewhere. she texts me on my phone after not picking them up one day saying, TELL THE GIRLS THEIR MOTHER LOVES THEM AND WILL SOO THEM SOON. MOMMY HAS TO GER HER LIFE STRAIGHT SO THE 3 OF US CAN HAVE A PLACE. that was more than 3 weeks ago.

so now some of her friends are asking my why i took her for full custody and cheated on her for 2 years...surprised me. i never took her for full custody or cheated on her. ive had to set the record straight to 4 different people, who dont know eachother by the way, because they all heard the same story, from the girls' mother, T. this has really stressed me out because everyone asks me why i did it, and its annoying. and from these "friends," now ex-friends, of hers, i hear the story that R may not be mine.

i have a girlfriend now for 2 months, and their mother, T has had her man just as long, maybe longer. she is now pregnant by him. i plan on moving in with my girlfriend soon. T still lives with her friend M, but plans on moving out back to the city, but not yet. she also plans on moving her boyfriend in with her then. her boyfriend already has a kid, which he sees everyother weekend. she has not called for the girls, or got them anything they needed like diapers or whipes, nor toys or anything for them. JJ actually thinks that a woman that works at another fast food resturant is her mother, when in fact it isnt, thats how much shes seen them. she plans on taking the girls this coming week with her to the other state with her partner-in-crime, who thinks im a lil boy hahaha. M hates me because i called her a liar. she said she would never lie to me about T being at work, then i find out that T was sitting next to her when she said it. thats concidered a liar. anyways, i dont want her to take the girls out of state, also to be around her friend. i want divorce by adultery on her part, full custody cause her living conditions are unstable, charge her for abandonment, meaning if she is convicted, she will face jail time for being on probation. might be just what she needs to get hr life straight. i did want joint custody, but she is talking about taking full custody of them. she claims her bf isnt a gang member, but his family is. i think thats unsafe.

My girlfriend cares for patients for a living. she knows how to give medications, and thats what R needs. R needs to take anti-rejection medication for the rest of her life, twice daily. my girls love her and she loves them too. they never call her mom, they call her by her name and she wants it like that too. i wouldnt need a babysitter because she works overnights and will watch them while i work. the girls will have their separate rooms from us, a nice size place, owned by us. i dont want to keep the girls from their mother, ill agree to supervised visitation. im tired of her lyin to her girls saying shes going to see them but end up not. their grandmother and grandfather on my side live close. T has no family closer than 5 hours from here.

I just dont think my girls should live with their mother who hasnt grown up from partying, and smoking weed, which i know she smokes weed but i cant prove it. i never smoked anything before or ever will, i dont party or drink since my operation. even before then i wasnt much for that. i should have listened T's mother when she said that T would do and say anything to get her way.

i know its a long story but thats it in short form, really. i just need advice. if you read this, i appreciate you taking the time. if you help me, i also appreciate that too.

Your story has so many different facets, it would be nearly impossible to address them all in a forum such as this. The best advice you could possibly get from this forum is to run--not walk--to the nearest family law attorney and try to establish yourself as the controlling parent. I fear if you do not, a third party will report your children as being at risk and then you BOTH will have to battle for custody.

It doesn't matter how many people you've talked to in order to 'set the record straight'. The only record that matters is not in the court of public opinion. It is in the Family Court itself.

If you do not establish your legal guardianship of these children, a third party ( such as social services ) very well may step in and suggest you are not physically capable of taking care of them, and place them in foster care. However, if you are proactive, with a good attorney presenting you as a capable, able bodied parent who should have custody of your children long before anyone notices that your children may be at risk, you stand a MUCH better chance of retaining and keeping custody.

Of course, there are other issues such as paternity, yada yada...but they are secondary to the safety of your children. I wouldn't waste a moment in acting TODAY. Clearly, as is the mantra on this site, you can usually get a free consultation with an attorney in your area. Also, virtually every state has free legal aid to those who qualify income wise. I personally would NOT go to social services----if they get wind of your situation as you presented it here, you very well may have caught the attention of the very entity you wish to have NOT notice you. Social services and family court are TWO separate entities that serve different functions. Part of the responsibility of social services IS to identify at risk kids and act according to the law in protecting them. I believe your ONLY option is to hire the best attorney you can find. You are going to need it.
