Default Can I appeale divorce. HELP!!!!!!!!!

My husband left country 12 years ago, than right away filed for divorce in Chicago, IL. without my consent, he never notified me about his intentions and plans for divorce.
After divorce he remarried, one reason for that was need for green card and authorization to work. I have never had a clue about our marriage being broken utill his recent death when I"ve found out about other wife.
What is statute of limitation if any to appeale divorce decree in Illinois.
I will appreciate all inputs very much

To someone unfamiliar with the particulars of your situation reading this makes no sense. You said he left the country 12 years ago--but you don't say he came BACK to this country and when. If he wanted a green card, why would he leave and marry someone else? Why not stay married to YOU if all he wanted was the ability to work in the US? You say you never had a clue you were legally divorced---did he LIVE with you as husband and wife all those years, in your house--and not with the "other wife"? Or were you separated, living apart, but not ( according to your understanding) legally divorced?
If you lived apart, with separate lives, why do you want to be married to a man who, first of all, does/didn't want to be married to you, and is, furthermore, regrettably and sadly, deceased? Do you have some legal reason/benefit for wanting to remain "married" to him?
How he divorced you without your knowing it is beyond me, and I have never heard of "appealing a divorce", but if you were living with him as married, and he somehow managed to divorce you without your consent or without your being aware, then you need a good attorney to address this particular situation.

Ok, I agree that my explanation wasn't clear to someone not knowing some of the facts. You sounded like you're not a lawyer but I will make attempt to put more light on my story.
I live in Poland and my husband left country(Poland) and me in 1995 to make some money in USA. His original plan was to stay in states for about a year and return. That obviously didn't happen. So now you get a picture about us not living together. But this isn't end of the story.
About 3 months after his arrival to USA he filed for dissolution of our marriage by publication. He never informed me about his intentions and actions, I've never received any divorce papers to sign, he did send them to some never existing address in city I don't even knew it existed but he still managed to obtain divorce decree. I probably wouldn't know about this and new wife until his recent death in traffic accident in Chicago area.
Do you have any idea how to take on this to void disoulution of marriage decree.
I will appreciate all tips.

If the divorce was granted in the US, you're entitled a full recorded copy available in the county recorder's office, i.e. Cook, Dupage, Will County, etc. You didn't indicate if your husband also became a US citizen when he moved to the US; if so, you should be able to contact a US Embassy in your area and obtain some guidance on how to proceed with this type of litigation. I'd also imagine the same services would be available at a Polish Embassy in your area, if one exists. Both offices are well-versed in both US and Polish law; both should be able to offer at least a place to begin. Some US states (including Illinois) DO allow divorce appeals, however depending on the location, this can be VERY expensive and can take possibly a year or so to resolve. Those states that do allow appeals also may have both time limitations and certain restrictions.

Here is a link that helps explain how the divorce was obtained without your knowledge. It may also offer additional information and resources(not legal advice):
http://www.illinoislegalaid.org/inde...ontentID=74 3. Your divorce decree will clearly state the grounds for the divorce...if you don't already have a recorded copy, I'd strongly suggest you obtain one.

Not much help, but hopefully, a place to begin. You can always post your case at www.legalmatch.com. Seek qualified legal counsel as soon as you can. Good luck to you.
