Question Don't I have any rights

After 12 yrs of marriage I find it hard to believe I have no rights. We purchased a house 9 yrs ago but because of my husbands ex- it was placed in his parents name. Now Im being told that I have no rights to this home.. and that I need to leave.. can I be made to leave my home? Title is in his mothers name.. but it was always known that this was our home... we have made upgrades to it as if it was our home.. now tha we dont get along I have to leave and I get nothing??

This really depends on the state. For example: The house would be considered separate property because of how it was titled. You may be able to show reasons for title (ex) but assuming it is considered separate: In some states marital assets (considered community property) put into the house can be traced and refunded back to the community in which you are entitled to 50%.

Community Property v. Separate Property can be confusing so check with an attorney in your state.

I am in california.. can they have me removed from the home.. either with a no tresspassing or restraing order.. Is there anything I can do to prevent them from trying to have me removed.. I just dont want to loose what I have and I believe that this house is part of what I have.. even if it is in his moms name.

Cool

It is going to be a long and expensive road to hash out the house situation. Like jurisPrudence said before you may be able to get reinbursement for money the community put into the house and the increase in value from the improvements made by the community.

If the house is titled in someone else's name then they can force you to get out.
