Default Can I sell a car titled in my name only that wife has possesssion of ?

I would Like to know if I can sell an automobile that is titled and insured in my name only, that my wife recently stole and took to Ohio and has possession of?
The car was Impounded by Ohio police as as stolen vehicle , but she told them that we were still married, and they released the car to her before I could fly from NC to retrieve the car and they also issued a protection order against me.
Can I sell the car since everything is in my name only, and have the new owner take possession of the car?
The car is registered and insured in NC solely in my name.

Please email me atoorxcusis@yahoo.com

Wink Community Property

Legally- in the state your in, I'm not sure. If you are still married with no divorce proceedings, then I would assume it's fair game. (I'd do it- just to make her mad) BUT, some would say different, I'm sure the courts would, just for the fact you are married. Community Property. Do you have another vehicle you drive? And do you have children together? Because this would determine whether or not you would be able to sell the car out from under her. Was all your vehicles bought before you were married to her? Have proof? Does she have a running vehicle in her name? If you were to take it to court questions like these would be asked in determining whether or not you or her could take/keep the car.
