I understand that property inherited by one spouse is seperate property. But
seperate property must be kept seperate. If the property taxes and insurance and improvements are made with community funds does that property lose it's seperate status? Thanks |

If community property funds are used to improve/pay for separate property assets the community is entitled to reimbursement for those payments.
For example you have a house prior to marriage and never change titled over to wife's name. During marriage community property funds are used to build a pool. This pool increases property value by 20%. Community is entitled to reimbursement and can claim property increase of 20% because community caused increase. Remember though community = both you and your spouse and is split 50/50 so you will get 50% of community property assets upon divorce. Reimbursement of the community can get very complicated. Best to hire an attorney who can trace all payments made by the community and determine exactly the amount the community is entitled to. |
