Do I need a Waiver after 5 years of Deportation, if Iam applying for a residence?

Hi,
On 2003 I got deported from US, to Brazil(where I come from),, and after that I got married with my American wife over there in the begin of 2004. And in 2005 I applied for my residence knowing that they were going to deny it, and I also applied for my waiver (I-212) through the INSS back in US (CA), with an immigration lawyer, but my waiver got denied, “who knows why”… and on this March will complete 5 years already, which was my punishment. Do I have to apply all over again, or the US embassy in Brazil will keep working on my file from 2005? Do I still need a waiver to get back in US after this 5years if I am applying for a permanent residence?
