Cool wrongful search or not

Here's what happen im sitting in my home watching my kids....and all a sudden a knock at the door....i look out my upstairs window and a policeman is looking thru a flower planter i have on the pic nic table... that nothing is growing in there empty...he then goes sneaks to my back door.... by this time im going down stairs to open the front door....the man at the door says he is serving a warrant on some girl i have never heard of ... he was at the wrong address ..in the mean time i did have 17 maryjane plants about 3 inch tall in a planter behind my house..... so now im in trouble because they came to the wrong house and found my plants.... or since they were at the wrong place don't that mean them seraching of behind my house was not legal... they had nothing for me somebody that i never heard of....... so they took all my plants ....left and said they would call me did not charge me with anthing yet did not even go to jail whats up here.... and i have no crimnal record in my life im 34.... weed should be legal anyway... do i have a leg to stand on?? hell i was at home minding my own... any advice would be great thanks...1 unlucky me...

can you see the plants from outside the property? Did you know growing marijuana is illegal in the states?

no u could not see the plants from the outside the property...only if u sneaked around to the back porch could u see the plants...and before he found the plants he was going thru planter's on the side of my porch. that nothing is growing in ..remember they are at the wrong address trying to serve a warrant...i have done nothing to bring them here or give consent to be on my property....my adress numbers are clearly posted on my driveway... along with a no treapassing sign up here at the house.... I think that is why they did not take me to jail.. because they were searching around the wrong house with no warrant... after they found the plants then they got a warrant to search the inside of the house......but if the tainted fruit law is right then the finding of the plants were iilegal... therefore the rolling papers and the 3 joints they found in my house can't be used against me ethier... cause if 1 piece of fruit is bad so is the whole tree...could this be right cause really they were trespassing.... and to search is to trespass....and yeah i know that growing weed is not legal... but i have chronic back pain and all pain meds make me sick as a dog... these were for me and not resale...im 34 never been in trouble in my life no crimnal record at all... can i be right on the iilegal search and they were for sure trespassing cause they were at the wrong house....any info would be great thanks so much legaleagle....

Search is probably legal is they reasonably believed they were at the right house searching for the occupant. Remember it is your word against theirs. Plus you were not arrested or charged with anything. If you are wondering if you will get your plants back the answer is no...

If you are charged or arrested the best bet is to hire an attorney who can review your case in depth including all facts and circumstances surrounding the misguided search.

No. no charges were filed.... ... they just walked down the hill with my plants and said thanks....... that they would call me... and set up a time for me to come downtown...my guess is then they will charge me...the only thing is they thought they were at the right house...even after my address number is posted at the end of my driveway.... not only that they were on the wrong road....hell who knows i have contacted a lawyer today and will be findin out something soon.... but it seems sad to be sitting in ur own home and all a sudden be surrounded by cops when u have done nothing to bring them there.. then all a sudden im in trouble cause they make a mistake..

Remember though you would not be in trouble if you had not been growing illegal drugs in your backyard. It like being pulled over for speeding on the freeway when you know you weren't speeding and them finding 50 kilos of cocaine in the backseat. You were just driving along "doing nothing wrong" and now your in trouble cause of their mistake. Problem is that in either situation just because you are "hiding your illegal activity" does not mean you are doing nothing wrong...only means that you have not been caught.

Good luck with the attorney. Its a good idea to speak to one regarding the situation.
