Do I have a case for violation of my rights?
While riding as a passenger in a vehicle traveling through NC, we were hit and sent into the car in front of us by a felony hit and run driver. We rolled several times and were hit again by another car after we stopped, as I was trying to free the driver of our auto, pulling her through my side of the wrecked vehicle. The first driver responsible wrecked his car shortly after and was arrested. 5 cars&trucks were involved and I was one of several people hurt. I was charged with posession of a stolen vehicle and put into a cell. I was vindicated by superior court and charges were disposed of but they made me post bail and return toNC twice for trial. I live in NY state and the car that hit us was from Tenn.
The Dist. Atty. report reveals that I was rever read my rights nor arraigned at any point yet held for 32 days before I got bail. I have undergone a spinal fusion at level c-5-6-7 and have to undergo more surgeries and anabolic steroid injections into the sites in my spine damaged by the accident. I repeatedly asked to see a lawyer and a doctor while being held on a false charge but never recieved the assistance I needed untill I could get back home. I have no legal assistance in any of the matters arising from this. I would like to know if I might have a case against the ones involved in preventing me from recieving due process. I have to have someone file suit against the parties responsible for my permanent injuries. This occured Oct. 4, 2003. I have recieved notice that I will be having a hearing for Social Security but no date given yet. I am now 47 yrs. old and have no hope of my life ever being the same as before the accident. What are my options and who is willing to represent me? I have kept a file of everything that has happened to me with much documentation. I would appreciate any assistance and advice, and I thank you for taking the time to review the facts involved.
