It doesn't make much sense to say you shoved a guy with his friends standing there---they could have just as easily beaten you up and left you there---one to four or five other people?
Also it doesn't make sense because he could simply DRIVE away. If Im in my car and someone approaches me and I am afraid, I could just DRIVE AWAY. If I was fearful for my life, I would not let him in the vehicle---I would step on the gas and get OUT of there. Did you know this person? Do they have any reason to lie? It is a weak case, but that doesn't mean it cannot put you right back in jail. |

Your problem is going to be his "witnesses". However, your strength in this case is based upon the fact that as they have told it, it doesn't make sense. I would consult with an attorney immediately.

I commend you for doing well with your life since being released.
They will have to prove you pushed the guy----but honestly it doesn't make sense why he would, in the presence of so many other people around him to assist him, get INTO a car with someone he was 'afraid' of. Everyone knows in cases of kidnapping, once you get INTO the car, the probability of you being seriously harmed or even killed is significantly increased. So to say he was scared so he got INTO the car (when you had no weapon, nor did you threaten him with a weapon) because of a SHOVE? Its silly. But, this is serious since you are on parole. I would contact the PD and/or a lawyer immediately. You have too much to lose to not protect yourself. |
