| Arrested but no Miranda? I was recently arrested but was not given a Miranda warning that I had the right to remain silent. Can I use that to my advantage? Can the case be thrown out based on the technicality? |

| It can be used to your advantage BUT the problem is going to be PROVING they did not Mirandize you........... |

| The police do not have to "Mirandize" you during an arrest. Unless you were interrogated, it's irrelevant. |
