Question will i have to serve time for these charges

hi my name is joe im 25yrs old i recently got aressted for disordery conduct,resisting arrest and simple assault i have only one other charge on my record for disorderly which was last year and i got 6 months probation and alcohol counseling i was intoxicated at the time of my recent arrest what are the cjances of me having to serve time for my second offense

Pretty good I'd say, but you could get a lenient judge who thinks the idea of incarcerating a person guilty of disorderly conduct with murderers, robbers and rapists just a bit too far... but then the judge might think it would teach you that your conduct is who you are and that you are not acting appropriately... and you need to stop drinking and carousing.

What do you think?

I might also add, judges do not MAKE the law. THEY APPLY it.

i see what u are saying i do have an alcohol problem but im not a criminal i could see a judge giving me a year and a year but u never know thanks for the answer

Joeh, you are being fed a healthy dose of misinformation.

Please check your private messages in the upper right hand corner of this site.

The LAW determines what the penalties are for certain crimes, not judges playing a judicial, whimsical game of "Wheel of Fortune". Your question can be answered with a great deal of specificity.

But the DA can take into account any extenuating circumstances. Six months probation LAST YEAR means it is probably long ago completed. So he is facing drunk and disorderly, resisting and assault, which prior to court could be taken down to an appropriate sentence for alcohol treatment/counseling by the local DA if he gets a lawyer working on his behalf asap. ESPECIALLY if he voluntarily goes for treatment... gets clean, finds work, and straightens his life around.

For this he has to mean business... or the state will do the work for him by incarcerating him. Hopefully that would be in the county jail.

Who is this person who does PRIVATE COUNSELING with NASTY OVERTONES? I thought this was a public forum where people could learn about the law. Defeating the purpose?

This site offers users the ability to contact each other personally. No one is "counseling" anyone.

Unfortunately, the presentation of accurate legal information causes some users to engage in personal hateful attacks, and since the objective is to provide those in need with accurate information, I choose to do so privately, which is, obviously, a function of this site that offers users the ability to private message. If you perceived something "nasty" in that, rest assured it is in the reading, not in the writing of the posting.

The reality is virtually every question being asked has already been answered publicly, repeatedly. Search the archives, if you like.

If you want public postings, try consulting one of my previous 1300+ previous postings. There should be enough material there to keep you busy for quite some time.

Sorry, but I've read many of your colorful posts. Obviously you knew who I was talking about, so you acknowledge that you are posting harshly. Seems you are the angry one, bitter that lawyers and others correct your first year law student knowledge. You used to go off on original posters and call them derogatory names because you didn't like their post. Then you began going off on others who posted to help. I've seen too many diatribes of ridiculously off base questions not to know that you have some problems not caused by these posters on here. So now you are "quietly" dissing them and telling the original poster that you are the authority they need but that you have to give it in private (so nobody can correct you again?). That is nasty. Tells the posters you are going to libel them in private. Shows you lack confidence and have a boatload of ugly feelings pushing you.

What are you on HERE for?
