Need advice, referal, post conviction relief.
I serve as an inmate advocate for a 44 yo black male in the NC Dept. of Corrections. He was sentenced in 1985, Life, Life and 18 years consecutively. Convicted for 1st degree rape, 1st degree ***. offense, armed robbery. Three others were involved. One testified against the others, recieved no time, another won on appeal, Two were tried together (my case). Place: Fayetteville, N.C. Cumberland County. Judge Lynn Johnson, Van Story D.A. later disbarred, charged with sell of narcotics, drug abuse, committed suicide, known corruption! No evidence other than testimony from victim and individual that turned states evidence. Crime occured in a car, never fingerprinted or biological evidence collected, panties with sperm in them were in evidence, no DNA testing ever done! Filed motions for DNA, Judge Lynn Johnson has turned motions down. He never sexually assaulted this victim. She douched and showered multiple times before going to E.R. for exam and rape kit >24 hrs after the crime. Photo line up used to identify him, he was the only one pictured with a goatee. Her statement was coerced over three days by detectives. No evidence existed! He has been incarcerated since age 19. He needs post conviction relief. Not elligible for parole until 2031 which excludes him from a MAPP contract now being used to get these old offenders out of the system, must be three years of parole date. He still remains in strict custody level, yet has no infraction to warrant this level of custody. We need help, I will do what I can financially because I do believe this man was way over sentenced! Today he would have never recieved this amount of time. One black juror, one black alternate. Victim white, a real no no in the 80's. Many discrepancies exist in this case. I have the entire transcript on my hard drive for easy transfer and review. We need a good referal! Judge Johnson is the Superior Superving Judge and always resides over his motions.
