Hello.
First and foremost, I want to thank the countless amount of help this site provides many people. Enough of that. I just have a simple question regarding trial procedure, or etiquette, im not sure what category this would fall under. If one part of my defense is based upon error in the prosecutions testimony (omitted information etc. . .), and I want to question the prosecutions witness, but only after the prosecution has rested, can I recall the witness to the stand once it is my turn to present my case? Or do I have to question the witness before the prosecution has rested, because from what I understand if the prosecution has not rested, and I find flaw in their testimony, they can simply have the witness re-testify once their testimony has lost water so to speak. |
