Question Appeals

To whom it may concern;
I'm writting this for my grandson, who is incarerated in the Utah State Prison. He was accrused to a *** offence. He is claming that he did not do this crime. But anyway he wanted to know if he can appeal his pre-sentence report? If you need more information on the case please contact me at my email address. mturn38@msn.com Thank you for your time.

Why does he want to appeal a REPORT--a pretrial one at that? Does he want to appeal his conviction? Did he plea, or did he have a jury trial or bench trial? Did he have an attorney? How long ago was this conviction? Is he within the time allowed for appeals ( of the sentence)?

Red face Appeals

May I get back with you on your questions at a later date. I must get the answers from my grandson when he calls me around July 12th or 13th. Sorry I did not have all the info for you when I posted the question. Thank you.
I think I can answer a couple questions. Yes he took a plea, and yes he had an Attorney( Public Defender)His conviction was April 25th 2008. It's been 2 months 11 days. It's not a pre-trial report, it is a pre-sentences report. I think he means the report that the prosecuter submitted before the Judge gave him his sentence. He feels that alot of the statements in there was not correct. He goes in front the the Board of Pardons in Jan 2013.He had went in front of the BOP just about 4 weeks ago.(June 19th 2008) Jan 2013 was the date they gave him to review his case again at that time.

From your posting, I believe the gist of your point is that your grandson feels as though he did not receive a fair trial ( i.e. not agreeing with the plea). He needs to hire an attorney to appeal his case---the whole case, not just a report.
