Hello All: Not exactly sure how this works but here goes. My daughter received two yrs for passing bad checks..She was arrested on 03/15/07 for this offense. She had a previous DUI which had come to court on 03/10/07 but she did not show and a capias was issued for her. While in jail awaiting the arraingement for the passing of the bad checks she went to court for the DUI and received 10 days in jail. When she was sentenced in 10/07 for the bad checks she was charged with a prior incarceration. The court counted the 10 days as a previous incarceration for the DUI..Even though when she went to court for the DUI she was already in jail. Would this count as a previous incarceration? Thanks Fred
