Exclamation husbands a 2nd striker need help w/ 1382!!

my husband is a second striker and is currently incarserated doing a parole violation. He is suppost to be released in 2 months but now it appears he has a warrent out for him for passing a fictious check. They have tried to 3rd strike him out before for something way little. He told me to file a 1381 and a 1382 form and that should help. What are those forms? What will they do to help him? And are there anyother forms or things i should do to try to help? How much would a lawyer usally charge to file those forms for him?

Default hannaih - need more info to help you

you need to provide more information regarding your husband's situation, like what state is he incarcerated in?
is the check charge a felony or misdemeanor?
I am in illinois, am familiar with this process here. I am sure it is similar only with minor differences. Default 2nd strike

and you are still married to this guy WHY ???? Why do you think that he is above the law on the 3rd strike law ? Hardly anyone else is - a crime is a crime - the fact that you said that his other "almost" 3rd strike deals were minimal doesnt set too well - if he did something illegal it isnt small no matter what it is.

I would tell him he is on his own and leave - I would NEVER stay with anyone being in and out of legal trouble over and over again. But thats just me -
