victim died before trial

Victim testified at prelim. Defendant was UNFORTUNATELY her own counsel !! Victim testified " I KNOW it was you". Victim was a 70 year old woman. She passed away from Natural Causes this past Wednesday. I say case shold be dropped because victim is not there to be cross examined by defendants new attorney. Victim was to give deposition this coming Tuesday. State says they will go forward with the case. On what foundation can the defendant use to have case dismissed? No forensic evidence was found at the scene.
