We do not know the posters jurisdiction but I also wanted to mention that in some areas, expungement is an option that could allow someone to claim "no" if, in fact, they had been convicted. However, that obviously takes time and not every charge and jurisdiction is the same in what/if they allow expungement.

It may be a possibility to keep in mind for a later date, although for a felony charge, I doubt it (Unless of course, he pleads down to a misdemeanor).... the possibilities are as endless as is the variant nuances of respective state laws.

Semblance could more intelligently assist you with California law since I am not in California, but I wanted to post this link for a starting place for a good clear tutorial on different types of domestic battery in CA.

I am not endorsing or promoting any attorney and in fact, I do not know personally ANY attorneys who practice in California. However, I did not want to copy and paste this information below without giving credit to its author, and I had no way of doing so without appearing as though I were endorsing this particular attorney. As I stated, this link is for informational purposes only and is not intended to promote a particular lawyer or law firm.

Explaining Penal Code 243(e)(1) PC: California "Domestic Battery" laws

Without being too inquisitive, were there circumstances of the incident in question which would, according to the information provided in the link above, definitively lead the charge to be a felony?
