| In Pennsylvania where my brother lives he was arrested in 1998 for simple assault which he served over 24 months in county jail with in 2yrs he had got in trouble again on a drug charge and went away for 5 yrs. He was released in 2007 and served 3 months on parole. When he was released the police harrased him. In september of 2007 there was a altercation between my brother and another person. Police were called, they searched him and found 2 percuset pills on him. He was arrested. While he was being arrested one of the officers said his name sound familiar. He was then taken downtown. He refused to go to the county jail because they began to accuse him of an 11 yr old felony rape. Supposedly 1 occured 3/31/98 the other occured 8/5/98 (which he was incarcerated at that time) hes been in the Pa system for the past 9yrs( not for violent crimes, but for drugs). They issued a warrant although he was never legally charged for that felony rape, hes never been through a line up, he has been in the legal system since then and hes never heard anything of this until now. He is now a resident of Kentucky and Pennsylvania is trying to extradite him back on that charge. Can he fight extradition to get a fair hearing in Kentucky? |

| He fled to Kentucky after these incidents? Your posting is confusing. The Sept 07 incident to which you refer---you do not specify which state he was in when it happened. And how can he be charged for a crime if he was in jail at the time? |

| No, he did not flee Pennsylvani. Understand he has been in trouble with Pennsylvania police since 1997. In 2001 he was sentenced to 5 years in a state penitentry and was not released until june of 2007. He was put on parole in the state of pennsylvania for 4 months. He then continued to live there for 2 to 3 more months and then went to ohio with our family. While he was in ohio his name was ran by there police 2 times, this also happened in 2007. And this fugitive warrant did not come up. My family relocated here in Kentucky in 2008. Recently the police ran his name again and this warrant came up. Pennsylvania was trying to charge him at first with 2 sexual assaults, 1 in March of 1998, and the other August of 1998. He was incarcerated in March of 1998. When Pennsylvania police seen he was incarcerated for the first one they proceeded to charge him with the second assault. These supposed charges are 11 years old going on 12. My question really is what is the stautes of limitations on that charge in that state? And how can you send a fugitive warrant out 11 yrs after the fact on someone who hasnt even been charged with the charge yet? |
