Angry Criminal DLS in Vermont

What is going to happen. My boyfriend was pulled over for no real reason and was cited to court for a criminal DLS, the took the plates from the truck and towed it. He has a prior DWI or DUI from 2 years ago, he has paid his fines, done CRASH and is off probabtion. What will happed with the criminal DLS does anyone know if there is a mandatory sentece in jail or can he do comunity service, house arrest... anything.

No 'real' reason? What does that mean? What was the reason ( real or not) that they pulled him over?

The sentence depends on all the factors you mentioned, as well as the state or municipality in which you reside. If he completed his probation, why does he not have his license? And, more importantly, why is he risking your life and the lives of innocent people by driving without a license?

I'd talk to an attorney.

the cop told us 3 excuses for pulling him over
1. he ran the plates and they came back suspened which was bull because they were in my name not his
2. Someone is your neigborhood called
3. I knew it was you, i saw you

He does not have his license back only for the reason that we have not been able to pay some of his fines.
Why he was driving is because he is stupid

LOL I appreciate your candor, and I have bad news for you. Boys who do this at his age don't get any better---they will do it all their life. Ask me how I know? LOL

Kidding aside--your first posting states "he has paid all his fines"---now you state he hasn't paid his fines. You do understand what that type of rhetoric does to your credibility, don't you? Also, you don't give his (or your) age.

In any regard, the standard of probable cause to stop a car is very different from probable cause to, say, enter a house. They cops don't need much to stop a car. If none of the reasons you gave were correct, why DID they stop him? If they didn't see who it was, they just got lucky and happened to stop him? I'm betting they saw him and I wouldn't be surprised if someone in the neighborhood DID call about him.

Oh, and one more thing--and I don't mean to be unkind--if he is driving because he is stupid, you are even more so---because it was YOUR CAR and you allowed him to drive, then, implicating you as well. Pretty crappy thing to do to someone you are dating/ in a relationship /friends with--getting their car towed when they did nothing wrong.

He got caught, and you were implicated. That's pretty rotten. You can do better. Good luck.

Hello, First I would like to say I am very sorry that the innocent like yourself have to suffer for a loved ones mistakes.

As time moves on I am sure you will get a better understanding in regards to the arrest. Yes get an attorney or at least consult with one with a prepared list of questions and concerns. If you can not afford an attorney you or your boyfriend may want to start making calls to the DOC (Department of Corrections) and give a gentle push to find out if one has been requested and when he or she will me assigned the case.

The penalty can vary depending one your boyfriends attorney and the state.

the whole fine thing is he paid off his fines for his DWI. He has other pervious fines from way before I ever knew who he was.
This is not anything I am trying to make personal here I just wanted to know if anyone knew what might happen! I can not control when someone get into a car and drives, I was not even around when he took off.

OMG.. nothing angers me than people who don't know the first thing about the law coming here and making UP things just to have something to say, in some frivilous competition with me. Doesn't it bother you in the least that valuable pretrial time and effort may be wasted by someone here actually believing this baloney??

Do you make this stuff up as you go along?? The Department of Corrections does NOT ASSIGN attorneys to the accused. The department of Corrections comes into play AFTER the defendant has been accused, tried, and found guilty. THEN the DOC comes into play. They have NO part in the pre trial phase. Find out if an attorney has been requested from the DOC? Who exactly do you think WILL request an attorney for the defendant? DUHHHHHHHH. Hold on to your hats here----THE DEFENDANT HIMSELF. Why would he have to call someone to ask if he has requested an attorney? I think he would remember if he asked for an attorney. How would anyone at the DOC know if the defendant requested an attorney?

If he does not have money to hire an attorney, he needs to contact the public defenders office ( NOT THE DEPARTMENT OF CORRECTIONS --snort, giggle). Gawd, just when I thought I had seen it ALL. Were I to not have a specialization in criminal law, I would STILL know that the DOC has nothing to do with assigning public defenders to those who cannot afford to hire their own attorney.

The penalty does not differ from attorney to attorney. The judge doesn't look down from the bench and say, "Whoa, dude, your attorney has a bad comb over. *gavel bang* you must go to jail for a year now. Tsk, tsk. Too bad ya didn't pick Mr. So-and So--ya would have gotten off lighter!!"

If you don't know the answer, don't answer it.

The correct answer is in my posting---the sentence he receives is dependant upon his age, his priors, the local and state laws regarding the same. The attorney he chooses has no bearing on the what the law says regarding the penalty for a particular crime.

God forbid some misguided poster actually believes this baloney you are making up.
