Default expired driver's liscense

My Illinois driver's liscense expired in 1986. I picked up a dui and a felony fleeing and eluding after that time,the flleeing and eluding are'nt on my driving record. Any way I read somewhere that if you don't have a liscense they can't charge you, or at least put it on your driving record, because you don't have a liscense. Is this true? Has any one ever heard of a constitutional drivers liscense?

Well, you still have a license--it is just expired. Fleeing and eluding aren't misdemeanor traffic violations, like speeding--thats why they aren't "on your record"----Although I doubt this to be the case. If you can't be charged, no one would GET a license--we would all just RUN when we saw blue lights.

What happened when you went to court? Do you have a license now? What state?

I haven't a clue what you mean by "constitutional drivers license"--but perhaps you meant to ask does the government have the right to first of all require us to have a drivers license, and secondly revoke our right to travel/drive if we do not?

I believe this is not unlike the discussion of "Is being required to pay taxes unconstitutional"? The site below explains, I believe, what your point is. HOWEVER, you broke the law and then your right to travel was revoked---I believe those that claim that the entire drivers license issue is unconstitutional do so when they HAVEN'T broken the law----not as an excuse not to be punished for doing the same.

It is unfortunate, in any regard---because it's because of people like you that people like me live without their husband and the father of their children. Unfortunately, all the licensure in the world cannot teach conscience, character, and integrity.

Are you a legal eagle or one of the drunk judges in vermilion county, Illinois?Hell I probably know more about the law than you do, I just had a question and you reply all crying and whining about your dead husband. Abd yes there is a constitional driver's liscense.I f you could just use your computer to find information instead of crying and whining around you might actually know something.

A fleeing felon that knows the law. (Well, aside from the obvious that escaped his keen notice---that, for example, fleeing isn't a TRAFFIC MISDEMEANOR to appear ON a driving record, like, oh, say, SPEEDING. If you use your car as a get away from a robbery, your driving record wouldn't say K-MART ROBBER. It might, however, say SPEEDING or TRAFFIC violations. Simply put, numbnuts, not every crime you commit appears on your driving record.

I also notice you aren't intelligent enough to provide other relevant details, such as the disposition of the case, etc. Also, the fact whether you have been issued a drivers license in another state is relevant. Poor thing--I must have asked too many questions all at once. Please, forgive me.

Also, you didn't say what YOUR definition of a constitutional drivers license is. And, as I expected, your implied definition is incorrect.

People argue that the laws regarding licensure of drivers are unconstitutional. Has it occurred to you to simply LOOK UP the answer yourself---or, come to think of it, since you know more law than do I, why do you even need to ask? But, I digress.

I answered your questions. There is a difference between questioning the constitutionality of laws governing drivers licensure and using the question of its constitutionality to attempt to avoid a conviction of a crime relating to the same. I know the difference is hard to understand--please, try NOT to spill your beer on your computer while you contemplate.

Bottom line: A consideration of the legality of licensure is one that does not involve avoidance of punishment for breaking of laws such as DUI or FLEEING. People who debate it, don't do so because they can't have a license as a result of CRIMES they have committed. Got it? You can have a DUI without a car. You can also FLEE without a car. The fact you were in a car and not on foot really isn't the issue. It is, in some ways, like a discussion of the legality of the death penalty---just because in some states it isn't ( or wasn't until recently) legal doesn't mean you can't be charged with a capital crime. Being the genius you are, surely you understand.

Whine about the death of my husband? How could I possibly do anything other than celebrate his life? He was more of a man in his dying moments then you have been your entire criminal fleeing drunken life. Pity? Eh, no thanks. I will, however, heap a rather large helping on you---to have so entirely wasted the gift of life you have been given by drinking, fleeing, not to mention risking the lives of innocent people as well, and then be unable to even articulate even the most simplest of thoughts in a cohesive sentence.
