I rented to a man who was always late on rent.
When he got far enough behind I had to have him evicted. He left the plase a mess, cost me $200 to have it cleaned. He moved to another state. I have his cell phone # but he will never return my calls. I still have a bounced check for $250 he never made good. He also owes me $750.00 in back rent that I have a promisary note for that was noterized at the court house. How should I go about collecting this? I'm afraid if I have to get an attorney I may spend more than that and still not get my money. I'm retired and the rent was a supplement to my income. this my only rental property. The rent problem is a civil matter. But since he gave me a bad check is that a criminal matter? Can I have a warrent issued on him? Thank you bej13 |

You will need to contact your DA's office to find out if they have a bad check department. If not they will know who handles bad checks in your state.
If they don't want to prosecute you will have to file in civil court. Many courts allow punitive damages (sometimes 3 times the amount of the check) plus the face value of the check. As for the amount on the promissory note you must go to civil court regarding this. Make sure that if you file in small claims they will allow service on individuals who live out of state. I know that this rule varies from state to state. |
