Default Vehicle in two names after breakup

Hello,
A little over two years ago, my fiance and I purchased a vehicle in both our names. I am the primary signer on the loan. We broke up about a year ago and no longer speak. I received notice from the bank that insurance on the vehicle expired last month. How do I go about getting my name off the vehicle? What kind of attorney do I contact? Any help is greatly appreciated, thanks!

You probably can't just "get your name off the loan". You signed for a loan and the bank will treat it as if you both owe the money, no matter who is the primary and who is the secondary signatory. The only thing you can do is to file for a transfer of the loan to only your former fiancé. The bank will probably do this for a fee and if you former fiancé agrees and reapplies for the loan.

The other alternative is to take over payments and perhaps sue for the car... but that's probably not worth it.

If you do nothing, the bank will either pay for the insurance themselves and charge you two, or consider you in breach of the loan and ask for all the money. They are probably contractually entitled to both. They can ruin your credit and sue you as easily as they can pursue your former fiancé.

You should always check with a local attorney to double check your options, but I don't think there's much more they can do for you then what I stated above.

In regards your question about "getting your name off of the vehicle, this post is to help from the financial perspective. The "transfer" already mentioned will require at the very least a written request from your former fiance. It's very unlikely they'll take it on face value, but require her refinance this into a new loan. There may be application fees involved and she'll may be required to provide the same documents the 2 of you did at the time you purchased the car .. possibly more. Any costs incurred while you are still on the loan will definitely be passed along to you and if depending on your current contract, you can also incur late fees, interest, etc. until that's paid.
