Age Discrimination, Plz Help, 11th hour..
My husband and I have signed a rental lease for a home in a 55 and older community and the move in date was today...2/05/09, However, we were originally told that the age rule was 80% to 20%. Meaning, that at least 80% of residents must be 55 yrs. of age and the rest can be under 55 but older than 18yrs of age. My husband is 47 and I am 40 and we do not have children and as I was moving in today the property manager told me to leave property and now is telling us we can't live there because "they" (the community) have changed the Florida State Real Estate Law and now made up a "Bi"- Law that there is no more 80/20 and that it is 100% 55 and older.
Does anyone know the R.E. laws in Florida regarding renting and have a signed legal rental/lease contract and now be refused due to age? Please Help, movers coming with truck tomorrow and my current house is already rented. Thanks, D |

Two things.
First of all, I do not know of any Florida state law, but homeowners boards, condo associations, etc are allowed to do stipulate the rules as they see fit. HOWEVER, the fact that they DID allow you to sign a lease and agreed to allow you and then rescinded, you should have legal recourse against them for not allowing you since they did, in fact, sign an agreement allowing you. I would consult with an attorney immediately before the unit is rented to someone else. Good luck. |
