I have a credit card debt of $2147.00. The attorney's firm sent a bill for over $6k. I negotiated with them to accept the $2147. The original debtor accepted the terms in Septebmer, 2008. I had asked the Attorney's firm to send it in writing and I would plan to pay it by October 31, 2008. They never did nor would they return my calls or emails. I have all of my paperwork regarding emails to them along with answers to the State Court (stamped)...and they are still seeking the $6k plus and are in process of garnishing my wages.
I am very frustrated as I have the money to pay this debt and they refuse to speak to me or respond. They responded one time by saying that it's too late to pursue...when they seeked a judgement on October 10th, 2008, 21 days BEFORE I had (according to them) to pay my debt of $2147.
I am considering coutersuing or seeking damages at least for my time. What are my resources?

You are the original debtor. They are the original creditor.
Did the original creditor accept the terms, or did the attorney? And, if they did, (either one) did they (either one) put something in writing? If not, I am not sure what you can do to prove that they did. Please clarify who exactly "agreed" to the settlement amount and how they agreed to it---verbally, on the phone, via email, etc.
