Exclamation need help with my lil boy

hi my name is Amber. my son was hospitalized in aug. of last year and my fiancee the following month was hospitalized for 43 days. so needless to say we got really behind in our bills and had to move with no money. well my sons god mother offered to keep him for me until i got back on my feet. i left my son with her after asking social services about the legalitizes of her being able to take my son to the doctor and stuff and we ended up just giving her a note to be able to take him to the doctor. (this is in NC) well i moved to texas while my friend had my son so that i could get back up on my feet in a more condusive economy. something happened and i'm not really sure what but social services called my ex-husband and had him come pick up my son a month after i left and they said they couldn't get ahold of me so they called him because i had abandoned my son which i never did my fiancee and i both spoke to my sons god mother over the phone multiple times. and social services wont tell me anything else they say its out of their hands now. my ex-husband had not ever seen my son since birth (for a year and 3months) before he took him. He has refused to give me his physical address. he filled the case however in VA. he wont let me see my son and my son is always (busy) when i ask to speak to him. i cant afford a lawyer and my ex doesn't have one either but he filed for custody on the basis that i abandoned my son and i need to know what to do now i'm so worried for my little boy becasue the things i've heard from my ex-s cousin were not good such as him feeding the children spoiled milk and i really miss my little boy and want him back home where he belongs. I haven't even been allowed to see him for nine months. please help

Well you should of got everthing in writing with the God mother before leaving the state. In my opinion you will have to start all over. I would move to the state where your son is and contact the court to establish visitation and you will probly owe child support. So make sure you have a job and perminant residence before you try to get custody. You will probly have to start with supervised visitation and estabilsh yourself with system... Good Luck.

What is "in writing with the Godmother" really is irrelevant.

The only thing that matters at this point is WHO has legal custody. The MOTHER does not have the authority to transfer custody to someone else---a court does. Now, she can transfer some forms of guardianship, but custody is a court determined designation. ( the courts try to give perference to the biological parent before passing the kid off to someone else. )

The poster doesn't say who has custody---she very well may still HAVE custody of her child---and if a court hasn't ruled otherwise, she DOES by default in that she is the birth mother.
