Default Help with paying for attorney fees

Hello,

I am new to the forum and need to fight for custody of my daughter. My ex has custody due to financial reasons and instability on my part, however I recently changed my life for the better by accepting a job out of state.

I want to fight for custody, and even though I am more financially stable now, I am on a budget. Will attorney's accept my case on contingency? What are the chances that if I win custody that my ex be ordered to pay for my attny fees. I am afraid that my ex will continue to tie up the courts to spite me because he knows that i can not afford a lengthy court battle. He makes five times my monthly salary and can easily afford to tie things up in court. Any advise would be greatly appreciated.

While I commend you on your personal progress, I regret to tell you that attorneys do not finance their services ( for the most part). Asking an attorney to finance a child custody case is like buying and eating groceries but asking the grocer to allow you to pay as you go. Obviously, there is no remedy for recovery if not paid for---the food is gone. Perhaps you can get a personal loan or short term loan to cover the costs of your legal expenses, but unfortunately, that isn't how attorney's work. If they did, the result would be their not getting paid for services and being unable to collect any type of collateral----what would a non payiing client do? Give their kids back? It just isn't practical or good business sense from a legal point of view.

That being said, attorney's very well may differ greatly in their fees. Shop around, ask for a free consultation or at least, a low cost. You can also look into legal aid services in your area if you qualify.
