Default i really need help

Hi, my 2 yr old sons father legally only has supervised visitation rights that was determined when i lived in another state. Now that I am back in the same state as him I have always wanted him to be involved he never wants to see him or even ask about him. While in court last week for child support b/c he is behind, I was informed he hired a lawyer to come after me again for custody. A few months ago he admitted himself to a looney bin for 2 wks. He has tried killing himself and I am scared for my son to be around him without me being there. I just dont know why he would need a lawyer when he already has rights but never uses them he has been in the same town as his son for 4 months and doesnt know his son at all. What do I need to do?

You have provided the answer to your question yourself. You state the gentleman in question is mentally unstable. Having an attorney doesn't mean that there is a legitimacy in his position--it merely means he found an attorney to take his money and 'represent' him.

Take your proof of his mental instablity to court. If what you say is true, a discerning judge will see right through his token efforts at custody.
