You have provided the answer to your question yourself. You state the gentleman in question is mentally unstable. Having an attorney doesn't mean that there is a legitimacy in his position--it merely means he found an attorney to take his money and 'represent' him.
Take your proof of his mental instablity to court. If what you say is true, a discerning judge will see right through his token efforts at custody.
