Unleashed Dog Hit My Car
I was traveling the speed limit when a large dog, with no leash or owner, came darting out into the street and hit my car. The dog lived (it got up and started jetting down the street). A person who viewed the accident told us it was her next door neighbors and we immediately told them what happened. The child of the family told us that he left the gate opened which caused the dog to run away. I have $750 in damage as quoted by my local auto repair show. My question is..
A) Can I take them to small claim courts for the car bill given the fact that their dog ran out of their yard due to their own negligence? B) Is there anyway they can sue us (and actually have a case)? We didn't violate any laws as we were going the speed limit. Thanks. |
