Insurance Company denying PIP coverage.

I moved back home to Hawaii and within 10 days of being back home I was rear ended by some idiot while I was stopped at a stop light. I was injured in the accident and since Hawaii is a no-fault state I needed to turn to my own insurance company for PIP coverage. Unfortunately, I was still covered under my California Auto Insurance Policy at the time because my vehicle arrived earlier than expected and my Hawaii insurance wasn't starting for another week. I did not have PIP on my Cali auto policy, because California is a at-fault state. I'm being told that they will not cover PIP coverage because I didn't inform them that I'm moving to Hawaii. This is completely false, I spoke to the insurance broker twice and informed him both times about my situation and asked him if I can extend my coverage until my Hawaii insurance kicked in and he said it's no problem and to just call the insurance company and renew my payment, so I did. Also when I called to make the payment I informed the insurance company that I moved to Hawaii. Neither of these two idiots had any concerns about me being in Hawaii and extending my coverage.

If they extended coverage to me in Hawaii shouldn't they have to abide by the local state insurance law's or at least inform me that they can't abide by the local laws prior to taking my payment and renewing my policy?

Also regardless if I notified them or not, if I was still living in California and drove into a no-fault state wouldn't they have to automatically adjust the policy to meet the local law of that state if I got into an accident?

I feel like the insurance company is screwing me. Am I wrong?

Any guidance would be greatly appreciated.

The insurance company under which you were insured should pay and the state in which the car was registered at the time is also important.

If you were within the time frame for switching over your insurance/registration, etc. then the accident should be covered under california laws.

Your insurance coverage should not be 'geographically' dictated. In other words, no matter where you go, you should be afforded the protection of the state of your residency.

I would hire an attorney--this is important to your future in consideration of your insurance premium rates going up.

Glad you weren't seriously hurt.
