Hello, first off if this isn't the correct place for this question please forgive me.
Ok to the question. I am preparring to launch a website that allows users to send mms messages to cellular devices. The users would be able to type a cell phone number into a web based form and send a message with pictures and or audio attatchments. Is there any legal issue that I may be over looking providing a service like this?

There are dozens of legal issues involved in what you are describing, from the name you choose for your business, to the way it interacts with the receivers cell phones. Do you possess the technology to do this? If so, from whom did you get the ability to do this particular thing? And do you have exclusive rights to perform this function using this interface?

I would consult with a patent and trademark attorney for starters. This is a rapidly developing area (technology) and a misstep could cost you dearly.

Thank you very much for your response. The ability to perform the function I'm speaking of isn't complicated at all really. Almost all providers allready offer the ability e-mail to MMS
Example: you can send an MMS to verizon customers XXXXXXXXXX@vzwpix.com
I was going to just take advantage of what they offer for the users of my site. My concern was more to the worries of abuse of such a service.
