Default LLC Transfer from another state

I want to get an LLC., transferred onto my name in IL which was originally created in state of WA. This LLC was formed a couple of years ago and my relative is the sole proprieter and he is willing to transfer it away as he doesnt have any interest in the proposed business.

I cannot get it registered again in my name applying for LLC formation as the name of the company "say xyz" is already in use and I have invested a lot of time and effort in forming the necessary business documentation etc., with the same name "XYZ"

Now, that I have a potential business opportunity I do not want to burden my relative with all the legal documentation...so what can I do to own it right away with the consent of my relative (and he is willing to transfer all his legal rights)

Please advise asap.

Here is the site for LLC forms in IL. I doubt you can use the same name as there is already one in IL. But you should contact the secretary of states office.

It is probably the FED Name that is in use and NOT within IL. In which case, will I be able to get it transferred...?

Are you saying that there is no LLC on file in IL that has the same name as yours? I am confused.

Default LLC sole proprietership transfer

Thanks for all your help in advance. I am in a situation where I definitely need some serious advise.

My application to form an LLC was rejected as the Name I need say "XaYeZ" is similar to the one already existing in IL "XAYeeZ".

Since the name I need is already registered to my relative in WASHINGTON state, I am assuming that the FED ID is accepted and I do have the legal FED-ID#

Now, I need to get it transferred over to IL completely with consent of the current owner. Is it possible? If yes, what are all the steps I need to take to get it transitioned over.

If there is no conflicting LLC in IL then file the appropriate form. There should be no problem.

Click on the link provided and possibly the form called "Application for Admission to Transact Business" is appropriate.

If I apply for the same name say "XayeZ" in IL. How will they maintain FED ID uniqueness...Doesn't the FED ID have the conflicting name?

also, how do I get the sole proprietership transferred to my name? Please read above for clarity if needed...
