Can I Break My Land Contract As Seller W/Distress
I hand wrote a land contract for my boyfriend's kids to purchase my home of my whole deceased family. I had JUST had a miscarriage, been thru a pregnancy alone, and was, and still am, involved w/an alcholic who is EXTREMELY controlling, manipulative, and caught me @ the worst time in my life. I allowed him to work out a land contract to sell my home with promises of him stopping drinking, no more abuse, etc. while I had a D & C, tubes tied, precancerous cell conization, and a fairly large cyst was found on my ovary & all this a month after a miscarriage. I was on medication & not at all myself. This was 5 months ago all w/promises of how he will help me keep my property while he does nothing but assure his family to go to the bank & get the loan to purchase it while we are currently living in TX & my home is in WV.....HE MOVED ME FAR AWAY SO I COULDN'T DO ANYTHING TO GET IT TAKEN CARE OF! I am also a diabetic of 29 years and that is also declining. I have no family nor funds. This home my mother was killed in front of, my father built it for her & I was born on it & he died on it.....SOMEBODY PLEASE HELP ME WITH SOME ADVICE AS I HAVE NO FUNDS! They paid $5000 down which I may be able to get it to give back w/the equity in my home. $38000 is mortgaged & I can sell it for $65000 even though he talked me into some hypnotic state of accepting their $60000 offer----which was paid in fuel & relocation costs. He even worked deals while I was ill & sold all my furniture.....I WAS COMPLETELY OUT OF MY MIND....Somebody please help advise me. I know to get an attorney, but I HAVE NO MONEY & HE HAS A LARGE FAMILY! CAN I BREAK MY LAND CONTRACT--WHICH STATED "BUYER CANNOT UNDO THIS LAND CONTRACT FOR ANY REASON OTHER THAN NOT PAYING PAYMENT"??....I am scared that I cannot legally undo this w/o large attorney fees....which I DO NOT have and cannot afford----which boyfriend has already brought to my attention...is there a way to undo this and keep my property??? I'M NOT ASKING FOR PITY.....JUST SOME ADVICE AS TO UNDOING MY MISTAKES....also, I didn't mean 2 just give myself a 5 star rating on this post....misunderstood what I was doing on that 1!.
