Please can you give me some advice on the following , this is my story ;
around 3 years ago i entered carcraft in liverpool with my girlfriend to look around , imediateley on arrival we where stopped in our tracks and asked to sit down with the sales advisor , after declining this offer , another sales advisor came over and finally talked us into sitting down , to which we where asked how much we where looking to spend , and we explained we where just looking but after much persuading finally agreed to fill in the questionaire , after which we where then free to browse around the showroom , or atleast that is what we thought , as we where then stopped again 10 minutes later by the same sales advisor who had greeted us on the way in , to which he began to show us around some cars which to be honest where way above the price i had stated on the questionaire . After much persuading i was talked into looking at finance options available , to which i stated that the repayments where to high and above what i stated on the questionaire , to this the sales advisor then called his manager over who then promised us that he could get lower repayments for us , and even £2000 cash back . Although this seemed very apealing it still did not get over the fact i had no id on me as i had only intended to look around , to which the sales manager said we could work around it and that if i gave him my cash card he would be able to take my account number and sort code and give me a better idea of the finance options open to me , so the sales manager took my details returned my card and sent us to get a coffee . 2 hours later we where still sat in the cafe we no sign of the sales advisor , we then made our way over to the reception and explained the situation , as we had now been in the showroom for 4 hours and where beginning to get restless to say the least , to which the girl behind the desk told us if we wished to come back another day we where free to leave , and we did. But as soon as we got into my car a man in a suit ran to the window and asked us to return as we wouldnt be much longer , i explained we had made arrangements to be somewhere else , but this seemed to make no difference and after 10 minutes of practically begging us to return we found ourselves back in the showroom . Another hour after returning to the showroom we where then finally taken through to a room at the back , where we were left waiting for 30 minutes before a different sales advisor returned with a contract . and he began to explain the repayments to which i responded to the fact that they where way above what the sales advisor had told me to expect in the showroom , and that there was no referrence to the £2000 cash back . With that he left the room to sort it out , 30 minutes later he returned stating that because i had no id it was only a temporary contract and that i would have to return tomorrow to sign a real one and the cash back would be on that one and the repayments would be lower due to the cashback , he then told me which boxes to fill in and through frustration did as instructed to which he then read it back to me . Finally we could leave , but no we where then told we would need to fill in some more forms and then the car would be mine to which i explained what the sales advisor had said about the contract , but it was then explained to me that if they got it all filled in tonight it would mean less time here tomorrow . I then proceeded to fill in the forms and upon completion was told that i could take the car home , as i was already in my own car , had no insurrance , or tax , and with the contract still as it was that i didnt want to take the car home , to this the sales advisor told me that they needed it off the forecourt , and that a other sales advisor would follow me home in the car and take my id documents off me , as this would speed up the process tomorrow and they could make a start on arranging the finance , so i then agreed . When we finally got home at around 11.00 on a sunday , yes they had stayed open to make this sale , and having time to think about what had happened , the day after i returned to carcraft , and stated my intentions to return the car and that i did not want to complete the contract . During the day i had recieved a phone call saying that the documents i had given them where incorrect , and i explained my intentions to the man on the phone , to this he told me to come in anyway and we'll have a chat , by this time i had done with chatting , and returned to carcraft stated my intentions and asked for my id back , but they where unable to find my id saying that the sales advisor must have taken it home with him and i would have to return later on . Later in the day i returned once again to be told that in order to cancel my contract i would have to ring the customer helpline , but yet i had been told this wasn't the correct contract , and that i didn;t have the correct id ,utility bill was the wrong date. With this news i left the showroom and upon returning home rang the customer helpline , who told me i would have to put it in writing , which i did as soon as i got off the phone, and posted the following day by regestered post . A few days later i recieved a letter satating that all figures had been explained to me and that they could not accept return of the vehicle , and that i would have to talk to on line finance about cancelling the contract , so after reading this i rang on line finance who told me that i would have to put my intentions in writing , which i did and also sent regestered post , but recieved no response . I then rang to make sure they had recieved my letter and was told they had and that they where willing to cancel all finance and insurances , as stated in my letters , and that carcraft would have to take return of the car , with this news i rang carcraft and told them what had been said to which thet replied that i would have to get online finance to fax carcraft stating this , which i did . After not hearing anything for a couple of days i rang online and was told a fax had been sent , i then rang carcraft who then denied any fax was ever recieved , this same situation happened for a month and then finally fed up with this farce cancelled my direct debit , and told online that i wouldn't be making any payments and wanted the car to be picked up. The car was in the same place that it had been dropped of around 3 months ago , never insured , and still not taxed . Some time later i recieved a phone call to say that the car would be repossed , to which i agreed as i basically just wanted to see the back of it . Around a month or 2 later i recieved a letter for a debt collection agency stating that i owed them £11.500 (the price of the car was £10.500) , so i went to see citizens advice , who where unable to help me , so i then sent them a letter highlighting what had happened , and recieved back a letter saying they would look into some of the questions raised in my letter , but never heard anything from them . Utill 2 months ago when i recieved a letter from another debt collection agency demanding i pay the full amount , as before with the last company i sent them a letter stating what had happened and once again they returned saying they would look into it , 2 week later i recieved a letter saying that they had looked into it and that i still owed the money and need to contact them asap , then the day later i received a final demand and threats of court action if i don't pay up in full or work out a repayment scheme , so £11.500 for a car i didn't even drive . After looking through my contract i have noticed that the date on the contract is not the date i signed it , i signed on the 19th and the contract is dated the 21st , the same day i posted my letter of termination , Is this contract still lagal?
