For all practical purposes, possession remains 90% of the law. In your case, your ex girlfriend (I really hope she is an ex after that!) possess your money. Now it's up to you to get it back. That requires a lawsuit and if she doesn't have the money at the end of the day, you probably will never collect from her.
Your options:
1.You can say she “stole” the money from you. That's a criminal matter. That would require the “State” to go after her, not you. “People vs. girlfriend” not “broke vs. girlfriend”. All you can do is take the matter to the police and try to get them interested in pursuing her. Given your circumstances however, I doubt they would do that.
2.Sue her. She probably won't even show up to court. You'll get a default judgment against her that you can pursue at any time in the next 10 years. If she has no money now, you can ruin her credit by reporting the judgment to the credit agencies. For the next ten years she will not be able to buy a house, buy a car, get a credit card or anything else involving her credit. And, if she ever has a bank account or any possession, you can go after it. The only way she will be able to get rid of that judgment is either trying to get it vacated early on or through bankruptcy. Bankruptcy will ruin her credit anyway, and getting a court to vacate the judgment will require her to actively defend herself in a new suit. If your case is good, you'll win anyway. Now the down side to this is that you will need to get a general civil litigation lawyer to file the suit, and a lawyer to collect against her if it goes that far. That will cost you some money.
3.Forget it, move on with your life. Revenge can be sweet, but it's rarely worth it.
