In March 1999, I had a judgment against me for not paying a credit card debt in the amount of $2,000.00. This past year in 2005 I was cleaning up my credit record. And this was all that remained. I called the lawyer that handled this in a another state. He requested copies of all my bills and copies of my check stubs. I sent him all this, with a request to pay monthly. I also sent time the first months payment. Almost a year later. This lawyer gives my account to another lawyer. The new one ups the amount owed now is $6,000.00. And this new lawyer doesn't want monthly payments. He has taken me to court in another state, and is "renew Judgment" against me.
I wrote the court and begged to continue to make the monthly payments, and not to renew this judgment. This new lawyer, sent me a copy of his reply to court to "Motion to Strike Defendant's answer and for Judgement on the Pleading" and he did a "Notice of Setting" which is March 2006. This is in another state, and I can't attend the hearing. Is there anything else I can do to stop this renewal judgment, and continue making the monthly payments until this debt is satisfied? |

I'm sure you think this whole matter is very unfair. Please realize that the legal system in this country is designed for people who are able to follow its rules. The opposing attorney will almost always be able to beat you on a technicality like throwing out your defense because you did not file this or that form in the correct format. That's why it's often better to spend the money on a lawyer now if you can't or are unwilling to settle the case on terms that the other side will accept. Ignoring these types of problems, or trying to be cheap in the solution never works. Good luck! |
