This issue is about a Lease/Purchase of an automobile. The Dealer sends statements with multiple charges but refuses to provide information about the charges while adding interest and late fees. They state they don't have to. I have no way of knowing what the charges are for or if they may be legitimate as they are all labeled "Auto Lease" without explanation. They have previously sent me a letter pretending to be from the Bank of Stockton demanding a large amount of money. I do not have any accounts with the Bank of Stockton. The vehicle is Dealer financed. I checked with the Bank of Stockton and they have no account in my name or any dealings regarding my auto account. I have sent all normal amount scheduled payments by US Postal Money Order,Certified mail to the Dealer. As per the USPS dating system they have received,signed for and cashed all payments in a timely manner prior to due dates. No additional fees or unexplained charges have been paid. I previously hired an attorney to resolve this matter, pre-paid him in full and heard from him once. At that time he stated he would get started on the resolution the following day. I have never heard from him again. He has refused to respond to emails,certified letters or phone calls. My Lease/purchase is up in Oct 2005 and I am concerned that they will not be honorable in the closing of this contract and I will be issued a large final billing without explanation before I can receive the title.

Sometimes it is better to pay to avoid the possible problems you discuss. Then you can sue for the money back that you believe is an overcharge in small claims court. But only use this option if you have the ability to pay and have the time to pursue this in a court of law. Otherwise consult with an attorney for other options.

That is my thought too. My problem comes in where they list 3 months back payments due when they signed for them and cashed them on time so I don't really know what to pay except some outrageous number they have come up with.
I hope a Judge can sort this out and make them give me an audit of my account so I can recoup my losses. I have all of my recp'ts. In addition to this, I am in West Virginia now and the dealer is in Calif. I will have the added expense of returning to Calif. to file suit. CRUD! ![]() |

You may also want to file a complaint about them with the Secretary of State of California. I doubt it will benefit you directly, but it may cause them some problems. As a financial institution operating in California, they are regulated, and actions by consumers against unscrupulous insurance companies and financial institutions are something that politicians like to pursue.
A threat of that complaint with a well drafted demand letter from your attorney may also wake up the “higher ups” at the leasing company to straiten out your problems. |

As an Update to this post:
I've paid off the contract. I've never received anything from the Dealer and NO assistance from the hired "Attorney"(See Atty.Records post). To compound the issue the Dealer refuses to send me a PAID contract or a CLEAR Title to the car. They did send me outdated DMV paperwork with the wrong license plate number and wrong state signed by someone representing themselves as a Bank Agent. Since they tried this fraud before, I checked, the bank in question has never heard of the signer. I've placed numerous calls to the Dealer and they won't come to the phone or return my calls. So just like the "Attorney" situation, I will be suing the Dealer for the amount of the contract and my expenses to attain a Clear Title OR a CLEAR TITLE. ![]() |
