bad lawyer???

have a multiple of questions!

unfortunatly my wife and i are almost at the end of our chapter 13 case, and we have just received a letter from our mortgage bank saying their taking us to court for foreclosure!!!!!!! for missed payements!. Well after we received this notice we did realize that we DID NOT miss any payments but were late cause they changed our due dates and it was a miscomm with the bank it's self, however the bank had sent our lawyer a notice to respond in a certain amount of days in regards to not having received payments. Well we found out that our lawyer is also in the middle of chapter 13 and goes through the same bank, so he felt it wasnt necessary to open any of that bank mail, so now were stuck with 1300$ in attorney fees or our house goes up for foreclosure, also our creditor just sent us a notice on one of our accounts saying we need to put money in that account, it's well past the 30 days after we filed so how can we use that in our favor, pls if anybody could give us some advice i would greatly appreciate it....
