Default Chapter 7 - can it be objected?

Is there anyway to object chapter 7 filing? Someone took a really substantial amount of money claiming he is starting a business, got lot of money from several people, sold his property, moved his family abroad and used it to settle there. He still works for a US company and is well paid. He went ahead and filed chapter 7. He claimed the business didn't make any money. It is real estate so the asset was still available to give back what he owed. Is there anyway to get all or portion of the money back? I can provide details if it helps.

That would depend on whether or not you're a recognized creditor involved in the BK action, in my opinion. Typically (depending on the jurisdiction,) creditors are given a certain timeframe to respond; I believe the standard is 60-90 days. Best bet is to contact the BK court in question to determine whether or not you can be included and what the timeframe/procedure is. http://www.legalmatch.com/law-librar...y-lawyers.html may be of some use to you. After that call to the bankruptcy court in question, you may also want to consult with an attorney. (Suggestions/opinions here, as always.)

Good luck.
