Default Can I file chapter 7 after a 13 goes in I NEED BOTH REALLY

i have to file a chapter 13 to save my house from sheriffs sale but i still need chapter 7 to discharge old credit cards medical bills etc. i guess you can not file both a 7 and 13 at the same time .. can i file joint 7 and then just me on the 13 to save my house i need a good legal opinion

You wouldnt need to do both - just do the chapter 7 and be sure to re-affirm your mortgage and any other loans you have that involve property you want to keep - at least thats how mine worked when I filed chapter 7 - I kept my house and my car and just had to sign a waiver telling them both that I intended on still making the payments and that they were being excluded from the bankruptcy

Bankruptcy laws have recently been tightened (nationally) to try and slow the rising numbers of debt write-offs. Contact a local bankruptcy attorney who offers a free consultation to determine if you ARE eligible to file with the new laws. He can determine whether a Chapter 13 or a Chapter 7 are in your best interest.
