| Not sure if I have a case. Hello. Thank you for taking the time to read this and more thanks if you help me answer my questions. I settled a WC claim in November. I fell off a roof on the job and tore my ACL in my right knee. This injury caused me a lot of pain and costed me my future military career in the United States Army. I wanted to get the surgery to fix this ligament in my knee and my lawyer knew this. However, I have been out of work for several months due to the state of our economy, I decided to settle for the amount offered by the insurance company and that my lawyer said he felt was a "very generous offer". Now that the claim is closed I have learned of others who have had the same case I have had and not only did they get the surgery they needed, they got twice as much in their settlement than I did. I hired this attorney when he was with a local firm. During the duration of my suit he broke away from that firm and started his own. I really feel that he just wanted to quickly close my claim so that he could get his percentage quickly. I do not believe he even tried nor did he even care to get me what I was entitled to. Is there anything I can do? |

| What is it you want to sue for? The WC case is closed---finding out later someone else got more isn't grounds for any kind of lawsuit unless you can prove that somehow your interests were not adequately represented or the lawyer was negligent in some fashion. |

Notice I quoted "very generous offer" in my first post. That is because that is what my lawyer said to me. After all is said and done I find that I could have received the surgery I needed. Being that he has been a WC lawyer for 12 plus years not to mention is years of experience in other areas of Personal Injury, I believe he knew he could get me more plus the surgery. If I had to guess, being that he just started his own firm, I think he needed money fast and just wanted to close my case as fast as he could to get his percentage. I was under the impression that if I got the surgery I would not be able to settle and if I settled, I would not be able to get the surgery. The money I received went towards bills and food being that I have a fifteen month old daughter. So I can not afford to get the surgery with the little bit that I settled for. |
