Question Auto Accident

I was just involved in an auto accident. My car is totalled and my back is in pain. What should I do first?

Talking Recent Auto Accident Victim

Being involved in an accident recently I can tell you the following:

Go to the hospital immediately after you realize that you are in pain. Keep all medical bills and records pertaining to the injury. If you wait too long this may seem suspicious.

Take pictures of the accident site and your vehicle as soon after the accident as you can. I personally have a disposable camera in my glove box just in case. Preserve evidence.

Take pictures of your injuries if they are visable. Your bruises and cuts will heal but if you don't take pictures you will have nothing to show the judge if it gets to court.

Contact your insurance company and the other driver's insurance company ASAP. Hopefully the other driver has insurance.

Consult an attorney to understand and preserve your legal rights. You should be compensated for all of your losses.

Cool Attorneys take auto accidents on contingency

Remember, if you are ever in an auto accident where you or your passenger suffers an injury, check with a lawyer ASAP. Attorneys take auto accident cases on "contingency". That means that you pay them only if you win. There is little risk to you to checking with an attorney.

However, although you absolutely should hire an attorney, be VERY careful about which attorney you hire.

Auto accident attorneys are VERY aggressive advertisers and VERY aggressive in signing up new clients. Why? Because injury attorneys make a lot of money on the cases for very little work. Auto accident attorneys, as do most contingency attorneys usually take 1/3 to 40% of the awarded judgment as their fees, plus they take the costs (out of pocket expenses) on top of that! Out of pocket expenses can also include medical or expert consulting fees so watch out!

What this means for most people is that, although they need to hire an injury lawyer for their auto accident as soon as possible, they need to be VERY careful in picking that lawyer and not just succumbing to aggressive attorney advertising or attorney sales pitches. Most if not all injury lawyers charge the same fees. However the quality of the services differs greatly. (A good attorney may settle your case for 5X the amount of a bad one.)

Be careful out there! Attorneys can still be sharks, especially injury attorneys in auto accident cases. Shop around and shop around quickly. You have a limited time and need to make an informed decision.
