car accident in no way my fault.

I have a few questions as I am new to being in a severe car accident. I was driving my boyfriends car with him and our child in it when we were struck head on. It was clearly the other drivers fault. I am not on the insurance policy and was contacted by my boyfriends insurance asking if I wanted to be on his claim. When I asked what that ment the woman said that I could either be on my boyfriends insurance claim or the other drivers insurance claim. She also said that if I was on my boyfriends insurance claim it would only cover my medical bills. But that if I was on the other drivers claim I would receive compensation for my medical bills, damaged items (ie my childs car seat), and pain and suffering. Which claim should I be on?

I think you need to talk to a lawyer immediately and be wary of insurance companies I am sure each company is trying to get out of paying by saying you should go on the other's insurance coverage. I don't know the policies of either party, but this sounds like a serious accident and having an attorney representing you will make them more honest. The best places to find an attorney are your State Bar Association, your local county bar association, or you can post your case on http://www.legalmatch.com/ . I wouldn't agree to anything with an insurance company right now, but I am just some guy on the internet and this is a serious situation so your best bet is to hire a lawyer.
