Post Auto Accident & Settlement for Minor

My son and I were both in an auto accident. What is the process for obtaining the settlement for my son? Will we need to establish a trust for him for it to go into? He is 15. We are in Texas. Thank you,

Personal Injury Process

If you are trying to file a personal injury claim make sure that you are doing it timely In Texas, the statute of limitations for personal injury cases gives you two years from the date of the injury to file a lawsuit in the state’s civil court system

Texas also follows the modified comparative negligence rule, which means that if you are at fault for any of the accident, your claim may be reduced by the percentage of fault that is determined you caused.

Texas also has laws that involve minors involved in personal injury settlements- Since minors cant sign a contract settlement, Courts have long used the guardian ad litem. Thats a whole different process that you need to get informed about

Also for the settlement pay out the money can be deposited in the registry of the court, and the minor can’t withdraw it until the minor turns 18

Best thing to do is consult a texas personal injury who knows the entire process
