I'm not too familiar with CA State Law, especially on matters of child support. Clearly, there is a responsibility for your fiance (should you get married, the marital union) to pay for child support. In the event that, should he become your husband, your fiance ceases making child support payments, it is possible that you may be required to make the payments in his place. Should this happen, however, you can opt to go your separate ways, in which case you will no longer be responsible for the child support (as it is usually clear who was originally expected to make the payments).

If this is of particular concern, you may consider consulting an attorney specializing in CA family law.
