There is no law that says you must be on US soil to be sued. It makes it more expensive to bring suit against you, sure, but it can be done. Also, if he wins, he can ask the judge to have YOU pay the charges and the cost incurred in doing so. (doesn't mean he will get them, but he can ask). Imagine the nightmare if everyone businesses sued had to be on American soil----no one would start a business overseas or do any type of any business overseas if that were the case.
