The FTC has established procedures in the collection of a debt by a 3rd party and some of your questions can be answered in their publication at http://www.ftc.gov/bcp/edu/pubs/cons...edit/cre27.pdf. In particular, § 805-811 of the Fair Debt Collection Practices Act may be of interest; you DO have certain rights when it comes to debt collection. (See §816 for state specifications.) If the collection agency doesn't comply with the actions as stated by law, then you may want to seek legal counsel, but at the very least, I'd strongly suggest you review & follow the steps outlined. Some action is required on your part in the meantime.
